Kidbook, Inc. d/b/a Upparent, Inc. ("Company", "we" or "us") respects your concerns about privacy. The privacy of our website visitors (“Users”) is very important to the Company, and the Company is committed to safeguarding it. This privacy policy (“Policy”) explains the types of Personal Information the Company collects, how it will be used and with whom the Company shares it (“Data”). "Personal Information" means any information that identifies or relates to a particular individual and also includes information referred to as "personally identifiable information", "personal information" or "personal data" under applicable data privacy laws, rules, or regulations.

Data may be collected by the Company through many different mediums. The Company may collect Data through the use of the Company’s mobile application (“Application”) or through its website (“Website”).

Additionally, consenting to our use of the Company’s HTTP cookie, browser cookie, and/or internet cookie (“Cookie(s)”), in accordance with the terms of this Policy when you first visit our Website permits us to use Cookies every time you visit our Website.

This Policy applies to all information collected by the Company, by any means, including but not limited to the following:

1. DEFINITIONS


1.1. Cookie

A cookie is a small file placed on the hard drive of your computer. You may refuse to accept browser cookies by activating the appropriate setting on your browser. However, if you select this setting you may be unable to access certain parts of our Website. Unless you have adjusted your browser setting so that it will refuse cookies, our system will issue cookies when you direct your browser to our Website.


1.2. Web Beacon

Pages of our Website may contain small electronic files known as web beacons (also referred to as clear gifs pixel tags and single-pixel gifs) that permit the Company, for example, to count users who have visited those pages and for other related website statistics (for example, recording the popularity of certain website content and verifying system and server integrity).


1.3. Flash Cookie

Certain features of our Website may use local stored objects (or Flash cookies) to collect and store information about your preferences and navigation to, from and on our Website. Flash cookies are not managed by the same browser settings as are used for browser cookies.


2. RESTRICTIONS

Children’s Privacy and Parental Controls. The Website is not intended for children under 13 years of age. No one under age 13 may provide any information to or on the Website. We do not knowingly solicit or collect Personal Information from children under 13. If you are under 13 years of age, do not use or provide any information on this Website or Application on or through any of its features/register on the Website or Application, make any purchases through the Website or Application, use any of the interactive or public comment features of this Website or Application or provide any information about yourself to us, including your name, address, telephone number, e-mail address, or any screen name or user name you may use. If we learn we have collected or received Personal Information from a child under 13 without verification of parental consent, we will delete that information as quickly as possible. 3. DATA COLLECTION, STORAGE, AND MARKETING

You may visit our Website or use our Application without providing any Personal Information, although the Company will collect certain analytics information discussed below.


3.1. Data Collected by the Company

The Company collects Data:

  • by which you may be personally identified, such as name, postal address, e-mail address, or telephone number ("Personal Identifiers"); or
  • that is about you but individually does not identify you, such as age, sex, citizenship or geographic location; and
  • about your internet connection, the equipment you use to access our Website, and usage details.


3.2. Direct Collection of Data from Users

Users directly provide the Company with most of the Data collected by the Company. The Company collects Data and processes Data:

  • automatically as you use the Application and/or navigate through the Website (information collected automatically may include usage details, IP addresses, and information collected through cookies, web beacons and other tracking technologies); and/or

The Company may also receive and collect Data indirectly from the following sources:

As you navigate through and interact with our Application and Website, we may automatically collect certain information about your equipment, browsing actions, and patterns, including:

The information we collect automatically is statistical data, and does not identify any individual. It helps us to improve our Website and to deliver a better and more personalized service by enabling us to:

Additionally, we cannot control the actions of other users of the Application and Website with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.


3.5. How the Company Uses Your Data

The Company uses the Data it collects about you or that you provide to the Company, including any Personal Information:

  • to present our Website, Application, and their content to you, as well as other Users;
  • to provide you with information, products, or services that you request from us;
  • to allow you to participate in interactive features on our Website and Application;
  • to fulfill any other purpose for which you provide it;
  • to provide you with notices about your account/subscription, including expiration and renewal notices;

4.1. Tracking Technologies and Advertising

4.2. Disclosure of Your Information for Third-Party Advertising

If you do not want us to share your Personal Information with unaffiliated or non-agent third parties for promotional purposes, you can opt-out by sending us an e-mail stating your request to support@upparent.com.


4.3. Promotional Offers from the Company

If you do not wish to have your contact information used by the Company to promote our own or third parties' products or services, you can opt-out by sending us an e-mail stating your request to support@upparent.com. If we have sent you a promotional e-mail, you may send us a return e-mail asking to be omitted from future e-mail distributions. This opt out does not apply to information provided to the Company as a result of a product purchase, warranty registration, product service experience or other transactions.


4.4. Targeted Advertising

If you do not want us to use information that we collect or that you provide to us to deliver advertisements according to our advertisers' target-audience preferences, you can opt-out by sending us an e-mail stating your request to support@upparent.com. 

We do not control third parties' collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative ("NAI") on the NAI's website, https://optout.networkadvertising.org/.

5.1. Use of Cookies

The Company uses Cookies in a range of ways to improve your experience on the Website:

In some cases, advertisements on the Website and Application are served by third-party advertisers, ad networks, and ad servers. These third parties may use cookies alone or in conjunction with web beacons or other tracking technologies to collect information about our users. This may include information about users' behavior on this and other websites to serve them interest-based (behavioral) advertising. 7. DATA SECURITY 

We have implemented measures designed to secure your Personal Information from accidental loss and from unauthorized access, use, alteration and disclosure. 

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Website or Application, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. We urge you to be careful when giving out information in public areas of the Website like Lists, Questions, and Polls which allow for posting, linking, or uploading comments, links to websites, images, messages, or other content (including recommendations, reviews, answers to questions, and comments), and any other interactive features (referred to as "Interactive Services") that allow users to post, submit, publish, display, or transmit to other users or other persons (referred to as a "post") content, comments, or other materials (collectively, "User Contributions") on or through the Application and Website. Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your Personal Information, we cannot guarantee the security of your Personal Information transmitted to our Website or Application. Any transmission of Personal Information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Website or Application.

8. CALIFORNIA 

If you are a California resident, under California law, including the California Consumer Privacy Act (CCPA), you have the rights outlined in this section. California Civil Code Section § 1798.83 permits users of our Website that are California residents to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes. California residents have the right to make the following requests: 

  • Deletion. You have the right to request deletion of Personal Information that we have collected about you. 
  • Copy and Right to Know. You have the right to request a copy of the specific pieces of Personal Information that we have collected about you over the past 12 months, including the categories of information, sources, and purposes of collection, as well as categories of third parties we have shared it with. 
  • Designated Agent. You may designate an agent to make a request on your behalf. That agent must have access to your account in order for us to verify the request.

If there are any conflicts between this section and any other provision of this Privacy Policy and you are a California resident, the portion that is more protective of Personal Information shall control to the extent of such conflict. Based on our understanding of the term "sell" under the CCPA, we do not sell your Personal Information.


8.1. Non-Discrimination. The Company will not discriminate against you, including by denying or providing a different level or quality of goods or services should you choose to exercise your options under the CCPA.


8.2. California Privacy Rights under California’s Shine-the-Light Law. California law permits users who are California residents to request and obtain from the Company once a year, free of charge, a list of the third parties to whom we have disclosed their Personal Information (if any) for direct marketing purposes in the prior calendar year, as well as the types of Personal Information disclosed to those parties. If you are a California resident and would like to request this information, please submit your request in an email to support@upparent.com.


9. NEVADA

If you are a resident of Nevada, you have the right to opt out of the sale of certain Personal Information to third parties who intend to license or sell your Personal Information. You can exercise this right by contacting us at support@upparent.com with the subject line "Nevada Do Not Sell Request" and providing us with your name and the email address associated with your account. Please note that we do not currently sell your Personal Information (as sales are defined in Nevada Revised Statutes Chapter 603A).


10. EUROPEAN UNION AND THE EUROPEAN ECONOMIC AREA

10.1. For individuals within the European Economic Area only. Under the General Data Protection Regulation (GDPR), in certain circumstances, you have the right to: (i) request access to any Personal Information the Company holds about you and related information, (ii) obtain without undue delay the rectification of any inaccurate Personal Information, (iii) request that your Personal Information is deleted provided the Personal Information is not required by us for compliance with a legal obligation under European or Member State law or for the establishment, exercise or defense of a legal claim, (iv) prevent or restrict processing of your Personal Information, except to the extent processing is required for the establishment, exercise or defense of legal claims; and (v) request transfer of your Personal Information directly to a third party where this is technically feasible.


10.2. In addition, where you believe that we have not complied with our obligations under this Policy or European law, you have the right to make a complaint to an EU Data Protection Authority, such as the UK Information Commissioner's Office.

11.3. Accessing and Correcting Your Information

You can review and change your Personal Information by logging into the Website or Application and visiting your account profile page. 

You may also send us an e-mail at support@upparent.com to request access to, correct or delete any Personal Information that you have provided to us. We cannot delete your Personal Information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

If you delete your User Contributions from the Website or Application, copies of your User Contributions may remain viewable in cached and archived pages, or might have been copied or stored by other Website or Application users. Proper access and use of information provided on the Website and Application, including User Contributions, is governed by our Terms of Use.


12. CHANGES TO THE POLICY

It is our policy to post any changes we make to our Privacy Policy on this page. If we make material changes to how we treat our users' Personal Information, we will notify you with a notice on the Website’s Privacy Policy page.
